General Update

  • The contract date and commencement time frames are for the construction part of the schemes.
  • The purchaser must have entered into the off-the-plan sales contract between 4 June 2020 and 31 December 2020.

Commonwealth

  • Building must commence after 4 June 2020 and within 3 months after the building contract date (extensions of 3 months will be considered where the reasons for the delay are outside the control of the parties to the contract).

State

  • Building can have commenced prior to 4 June 2020. However, if signing a building contract after 4 June 2020, construction must commence within 6 months (extensions will also be considered).

Contract to build:

  • The applicant must generally be registered on the title as owner of the land by no later than the laying of foundations.
  • When titles have not issued because the land on which the new home is being built is in the process of being subdivided, the Commissioner may accept an application if satisfied the land survey plan and certificates of title will be issued in the name of the applicant. For example, the Western Australian Planning Commission has granted conditional approval of the proposed plan and lots.
  • Applications must be lodged by 30 June 2021.

Off-the-plan contracts:

  • An application can be lodged once registered on the certificate of title.
  • There is no closing date for applications.

Commonwealth, Contract to build:

  • An application can be lodged once registered on the certificate of title.
  • Applications must be lodged by 31 December 2020, but applicants can upload supporting documentation later.
  • The latest date to upload supporting documentation is 31 October 2022, so the applicant must be registered on title by then.

Off-the-plan contracts:

  • An application can be lodged once registered on the certificate of title.
  • Applications must be lodged by 31 December 2020, but applicants can upload supporting documentation later.

Renovation contracts:

  • The applicant must be registered on the title at the date they enter into the contract for renovation works.

First Home Owner Grant (WA):
Applicants must be registered on the title as owner of the property before the grant will be paid (and house must be completed for owner-builder).
Definition of Commencement of Construction

  • Construction commences when significant earthworks, excavation or physical building works commence.
  • Preparatory works such as site clearing, fencing, markings, delivery of building products will not be considered to be the commencement of construction.
  • Evidence may include a declaration from the builder, invoice, photographic evidence, etc.

Timing of Commencement of Construction WA Building Bonus: Contract to build:

  • Construction must commence within 6 months from date of the contract
  • There is no discretion available to the Commissioner to extend the date for the commencement of building.

Off-the-plan contracts:

  • Construction can commence:
  • prior to the contract date; or
  • within 6 months from the contract date.
  • The Commissioner may approve an extension of time to commence building beyond six months where the reasons for the delay are unforeseen and beyond the control of the parties to the contract.

Commonwealth:

  • Construction must commence on or after 4 June 2020 and within three months after the contract date
  • The Commissioner may approve an extension of time to commence for a further 3 months where the reasons for the delay are unforeseen and beyond the control of the parties to the contract.

Timing of payment. WA Building Bonus: Contract to build:

  • Once foundations are laid or once the Commissioner is satisfied the land survey plan and certificates of title will be issued in the name of the applicant.

Off-the-plan contracts:

  • Once registered on the certificate of title.

Commonwealth, Contract to build:

  • Once foundations are laid

Off-the-plan contracts:

  • Once registered on the certificate of title.

Renovation contracts:

  • Once $150,000 of the contract price has been paid.

Payee:

  • Building Bonus and HomeBuilder grants – applicant’s bank account or another nominated bank account.

First Home Owner Grant – Financial Institution or applicant depending on who lodged the application.
