AICWA recently advised members of the decision by The Registrar of Titles Ms Jean Villani to introduce a change of lodgement processes by August 1st 2017.
On August 1st this year, Landgate introduced changes to lodgement process affecting mortgagees, specifically, for the electronic lodgement of mortgages and discharges of mortgages (via PEXA).
It is now envisaged that the next step towards paperless conveyancing is for the scope of eligible document types to be broadened so as to include:
Landgate is seeking comments and feedback from the AICWA on the proposed change. While the finer details of the process have yet to be determined Landgate have indicated that they wish to understand what potential issues or considerations exist in implementing this “next step”. An investigation followed by a lengthy consultation period will hopeful ensure the creation of processes that are accepted by the majority of AICWA members. It is important to note that there are many external impacts that will result from this change that impact conveyancers. Landgate are keen to understand these impacts and where possible work with AICWA to achieve or facilitate positive outcomes.

Landgate (WA Land Title OFfice) force PEXA use; Electronic lodgement of stand-alone Mortgages and Discharges of Mortgages will be effective 1 August 2016
On 4 April 2016 a letter was distributed to industry bodies and Customer Information Bulletin (CIB) recipients. This letter notified Landgate’s intention to introduce changes to the lodgement process for mortgages and discharges of mortgages that will affect mortgagees, their conveyancers, lawyers and lodging agents by 1 August 2016.
Industry bodies and CIB subscribers were invited to provide feedback on the changes. The timeframe for receiving feedback has now ended. This CIB is to notify that Landgate will be progressing activities to achieve the 1 August 2016 timeline.
Whilst all 4 major banks are fully committed to e-Conveyancing, not all transactions are currently in scope. This is due, in part, to the fact that banks still require a paper mortgage signed by the client (even though an e-Mortgage is signed by the bank in PEXA). Where the banks settle in, PEXA said paper mortgage needs to be a “new” MA document (akin to the T2A). A couple of the banks are yet to finalise this issue. The current status is as follows:

The new levels of First Home Buyer Duty levels are nil for under $430k and revert to normal at $530k effective from 3 July 2014.
Royal assent was granted on 2 July 2014, so now applies to all First Home Buyer contracts dated 3 July or later.

Despite lack of media coverage, Landgate Verification of Identity process still fails to link the real seller to the property.
As a knee jerk reaction by Commerce and Landgate to ministerial pressure of stopping Real Estate Fraud in WA, Commerce intiated 100 point ID check of all sellers for WA property. Landgate further restricited what ID could be used along with who could do the ID process but remained VERY silent on how to link the seller to the property. Whilst placing onus on Solicitors/Lenders and Conveyancers in WA to be reasonably satisifed of that fact.
What many people may not know, that Property fraud in WA continues even with proper ID checks being conducted.
The problem lies in linking the authority of the seller to the land. Since any fraudster can easily obtain fake ('but still real looking') ID, unless that ID is linked to the sale of that land they could pretend to be anyone and sell anyone's property.
Landgate have offered a caveat that can only be removed by Seller in person with proper ID. But currently only solicitors or public direct can prepare this document. It causes all sorts of issues if the seller is unavailable to present themselves in Person at Landgate for it's removal!!!
It has been suggested that Landgate as the registrar of Titles in WA utilise a "notice of intent" be registered along with ID that can then be searched by all parties of the transaction to satisfy that if contract for the sale of land in WA where to hit a solictitor, conveyancer or lenders desk they could check that the registered proprietors have been properly Identified and linked and to the WA property.
